Introduction

Allergies Shaped My Life Foundation (the “Foundation,” “our,” “we” or “us”) is located in Ohio, United States of America. The Foundation is at all times interested in providing you with the best possible user experience, respects the privacy of our donors and is committed to protecting the personal information that we gather and maintain regarding those donors. This Privacy Statement and the Terms of Use (“Terms of Use”), located at Terms of Use, describe how the Foundation handles your Personal Information. This Statement applies to the collection of donor information from any source: physical pledge cards, on line pledges, our website located at www.allergiesshapedmylife.org (the “Website”), electronic communications, registration for an event or fundraiser or by any other means.   

The Foundation focuses its client portfolio and services in the United States and does not provide services or target its marketing or advertising to individuals and companies outside this area. Accordingly, this Website is intended for use by individuals in the United States. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative, at your sole risk, and you are responsible for compliance with all applicable laws. If you are located outside the United States and would like to contact us or provide us with Personal Information (defined below), please contact us directly and not through the Website.  

Acceptance of Privacy Statement. By continued access or use of the Foundation’s Website, or by indicating your consent to this Statement, you consent to the terms of this Privacy Statement (“Statement”), and you expressly consent to the Foundation’s collection, storage, use and disclosure of your Personal Information that you may provide through interaction with the Website as described in this Statement and the Terms of Use . Please read this Statement carefully. 

When you access this Website, you understand and acknowledge that the Company may transfer, process, and store information about you in the United States and other countries, both within and outside of the European Economic Area, as data center redundancy changes may be implemented by our service providers in the future. By providing us with your information, you consent to the transfer to, and to the processing and storage of your information in, countries outside of your country of residence, which may have different data protection laws than those in the country in which you reside. 

1.     Purpose. The purpose of this Privacy Statement is to inform you about the types of information the Foundation might collect from you when you visit the Website, how the Foundation may use that information, and whether and how the Foundation discloses that information to anyone.   

2.     Information Collection and Use. The Foundation gathers Personal Information, which is any information that identifies a user or makes a user identifiable (“Personal Information”), about the users of this Website to further its legitimate interests in the operation of its business. Personal Information is obtained when you request services offered through the Website or when you submit information through the Website.  The Foundation does not seek or accept sensitive Personal Information from visitors to the Website, and, to safeguard your own sensitive Personal Information, please do not provide any sensitive Personal Information, and limit the amount of all other information that you provide through the Website to the greatest extent possible. 

The Foundation automatically receives and records information from your computer or browser, including your IP address, cookie information, software and hardware attributes and the page(s) you request.  Any information that is anonymized or aggregated is no longer considered Personal Information. The Foundation collects the following information about its Website visitors: 

a.     Name, address, e-mail address, telephone numbers, and physical contact information provided by you, donation amount, designations, donor history, contributions, student identification and school information and limited demographic information; 

b.     Information regarding pages visited, quantity of searches performed, and keyword searches; 

c.     Community discussions, dispute resolution, correspondence through the Website, and correspondence sent to the Foundation; 

d.     Supplemental information from third-parties, including doctor verification of allergies and business partners of the Foundation. 

The Foundation uses this Personal Information for the following general purposes: (i) to gauge the level of traffic, speed, and overall performance of the Website; (ii) to customize the advertising and content on the Website to its target audience; (iii) to fulfill demand for services and content on the Website; (iv) to improve the Website and the experience of users of the Website; (v) to contact you, (vi) to conduct research or other internal business purposes, (vii) to provide anonymous reporting for internal and external clients, business partners and affiliates of the Foundation, (viii) to administer and maintain records relating to donations, (ix) to facilitate fundraising, (x) to communicate with donors about the Foundation, (xi) to distribute receipts to donors, (xii) to bill donors for unpaid pledges, (xiii) to thank donors for their support, and (xiv) to comply with legal or regulatory requirements. 

The Foundation uses a third-party online payment processing service with high levels of security. The Foundation does not store, nor does it have access to, credit card information, bank account numbers, or other account data sent to the payment processing service as part of an online donation, purchase or registration. Credit card numbers, provided by donors through electronic means, are not retained by Foundation employees, nor do they have access to them.  Credit card numbers provided by donors through any physical forms or via telephone to authorized Foundation employees are securely transmitted to the third party online payment processing service and are then destroyed. 

3.     Information Sharing and Disclosure. The Foundation does not rent, sell or share Personal Information about you with other people or non-affiliated companies except to provide content that you have requested, to provide services to you, or under the following circumstances:  

a.     The Foundation may share Personal Information with its advertisers, its web administrator, and analytics service providers, such as Google, to help us better understand the Website and services, as well as user behavior. The sharing of Personal Information is only in the aggregate and no information specific to you is released.   

b.     The Foundation may disclose Personal Information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. 

c.     The Foundation may share Personal Information where the Foundation, in its discretion, deems it necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Foundation’s Terms of Use, or as otherwise required by law.  

d.     The Foundation may disclose Personal Information to enforce its policies, respond to claims that a listing or content violates the rights of others, or protect anyone’s rights, property or safety.  

e.     The Foundation may transfer Personal Information about you if the Foundation is acquired by or merged with another company, or if the Foundation forms a division or affiliate and transfers thereto the ownership and operation of the Website. In this event, the Foundation will endeavor to notify you before information about you is transferred and becomes subject to a different privacy policy using the Personal Information that you have provided to the Foundation.     

f.      The Foundation works with contractors, vendors, partners, advertisers, affiliates and other service providers in different industries and categories of business, including, but not limited to, cloud storage providers, the presenters and preparers of the content contained on the Website. Such vendors may be given your information for such use.  

g. The Foundation may share Personal Information where consent to share such information has been provided to the Foundation by you.

4.     Links to Third Party Sites and Services.  The Website may contain links to third party websites operated by individuals or companies unrelated to the Foundation.  Please be aware that the Foundation is not responsible for the privacy practices of any third-party websites. The Foundation provides links to these websites for your convenience only, and you access them at your own risk. The Foundation recommends that you review the privacy policy and terms of use posted on third-party websites prior to utilizing them. 

5.     Foundation Communications. The Foundation reserves the right to send to you, by e-mail or otherwise, communications relating to the Website and the services provided by the Foundation, including, but not limited to, service announcements and administrative messages.  By registering with the Website, you are agreeing to receive such communications. Please contact us if you wish to unsubscribe, or use the unsubscribe link at the bottom of one of our emails. Note that unsubscribing to emails or requiring the Foundation to delete your information may restrict the Foundation’s ability to provide services to you.  

6.     Minors. The Foundation is committed to protecting the privacy of children. The Website is not directed to and does not intentionally collect information specific to individuals under thirteen (13) years of age.  Any individual under the age of thirteen (13) must have the consent of a parent or guardian prior to accessing the Website.  Inasmuch as the Foundation cannot control a child’s access to the Website, the Foundation encourages parents to utilize Web filtering technology to help you supervise your child’s use of this site and the Internet in general. If a child under the age of thirteen (13) has provided us with Personal Information online, the Foundation asks that a parent or guardian contact us.  Please visit the FTC's website at www.ftc.gov for tips on protecting children's privacy online.   

7.     Cookies. In order to optimize and/or personalize your experience, the Foundation utilizes a common feature of your browser known as a “cookie”.  Cookies are files stored on your computer’s hard drive that maintain information about your name, passwords, preferences, and browsing history, among others.  The use of cookies allows us to provide you with a faster, better, and more personalized experience on the Website.  The Foundation may set and access cookies on your computer. If you employ a “do not track” mechanism on your browser, please be advised that the Website does not respond to “do not track” requests or similar signatures that users may employ.  You may refuse or delete cookies; however, some of the Website functionality may be impaired.   

8.     Security. Your information is stored on the Foundation’s servers or cloud based services located in the United States.  The Foundation treats data as an asset that must be protected and uses tools (encryption, passwords, physical security, etc.) to protect your Personal Information against unauthorized access and disclosure.  The Foundation’s employees, agents, representatives and contractors who have access to Personal Information are required to protect this information in a manner that is consistent with this Statement. However, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your Personal Information that they collect from the Website.  Therefore, although the Foundation works hard to protect your privacy, and maintains reasonable physical and technical safeguards on this Website, the Foundation does not promise, and you should not expect that your Personal Information or private communications will always remain private and secure.      

9.     Governing Law. You represent and warrant that you are domiciled in the United States. You agree that the laws of the State of Ohio, United States, will apply to this Statement and your Personal Information without regard to laws relating to choice or conflicts of law. Any dispute, claim or other action taken by you must be filed in the courts located in Summit County, Ohio, United States. You irrevocably consent to this venue.  

10.  California Privacy Rights.  California law permits individual California residents to request certain information regarding the Foundation’s disclosure of Personal Information to third parties for their direct marketing purposes during the preceding calendar year, among other rights afforded by the California Consumer Privacy Act. 11.  Amendments. The Foundation reserves the right to amend this Statement at any time by posting the amended terms on the Website.  All amended terms automatically take effect when posted and are binding without further notice to users.  The effective date of this Statement is located at the end of this Statement. The Foundation encourages you to periodically review this Statement so that you are aware of any changes.
